First Home Buyers

Do first home buyers pay stamp duty in NSW?

Not always. The NSW Government's First Home Buyer Assistance Scheme reduces or eliminates stamp duty costs depending on your purchase price. Check your eligibility and explore first home buyer grants and schemes before you calculate your total upfront costs.

Full Exemption

Properties up to $800,000

No stamp duty payable. The property must be your primary place of residence and you must not have previously owned property in Australia.

Concessional Rate

$800,001 to $1,000,000

A reduced stamp duty rate applies. The concession tapers as the purchase price approaches $1,000,000, above which the full rate applies.

No Exemption

Properties above $1,000,000

Standard transfer duty rates apply in full. No first home buyer concession is available at this price point regardless of buyer type.

Alternative Option

Annual Land Tax Instead

Eligible first home buyers can opt to pay an annual property tax instead of paying stamp duty upfront. Whether that suits you depends on your situation and how long you plan to hold the property.

FAQs

Frequently asked questions about NSW stamp duty.

Stamp duty in NSW (formally called transfer duty) is calculated on a sliding scale based on the property’s purchase price. For owner-occupied properties, rates start at $1.25 per $100 for values up to $16,000 and rise to $47,295 plus 5.5% on the amount over $1,168,000. Use the stamp duty calculator NSW above for an exact figure.

First home buyers in NSW may be eligible for a full stamp duty exemption on properties valued up to $800,000, and a concessional rate on properties between $800,000 and $1,000,000. Eligibility requires the property to be your primary place of residence and that you have not previously owned property in Australia.

Yes. Investment properties are subject to the standard transfer duty rates and are not eligible for the first home buyer exemption or concession. The rate is calculated on the purchase price using the same sliding scale as owner-occupied properties, but no discounts or concessions apply. Use the calculator above and select Investment Property to see your figure.

There is no legal way to avoid stamp duty entirely unless you qualify for an exemption — most commonly the First Home Buyer Assistance Scheme for properties under $800,000. NSW also offers a land tax option (an annual payment instead of upfront stamp duty) for eligible first home buyers. A Sydney mortgage broker can help you understand what applies to your situation.

Stamp duty in NSW is typically paid at settlement, which is usually 30 to 42 days after exchanging contracts. Your solicitor or conveyancer will arrange payment on your behalf. It must be paid before the property transfer can be registered with the NSW Land Registry. Factor this into your total upfront purchase budget.
